Delaware County Court Records
Per Section 1.0 of the Public Access Policy of the Unified Judicial System of Pennsylvania, Delaware County court records include indices, dockets, and documents (opinions, decrees, orders, and judgments) for any case submitted to, accepted by, and preserved by a court or custodian. These records are held by the office of the Clerk of Courts in the Delaware County Court where the case was heard.
The primary purpose of court records is to maintain an official account of court proceedings in keeping with the provisions of Pennsylvania Public Records Laws. Hence, they are considered part of Delaware County's Public Records and are a vital information source for members of the public.
Are Court Records Public in Delaware County?
Yes. The Pennsylvania Right To Know Law states that a court record must be available for viewing and duplication unless another law/statute specifies otherwise. The Unified Judicial System of Pennsylvania Public Records Policies Section 3.0 and the Delaware County Open Records Law also make provision for court records in Delaware County to be accessible to members of the public.
However, not all court records are open to public inspection or duplication. Records containing confidential information such as social security numbers, financial/account numbers, driver's license numbers, state identification (SID) numbers, names and dates of birth of minors, abuse victim addresses, and other contacts are not open to the general public.
What Do Delaware County Court Records Contain?
Court records include information about legal procedures within Delaware County. They typically contain the following:
- Party information (role, name, aliases, type, and status)
- Attorney information (ID number, address, phone number, signature)
- Case information (judge assigned, case number, title, and classification, filing date, OTN, arresting agency, complaint and incident numbers, disposition, county, and arrest date)
- Status information (case status, status date, and processing status)
- Calendar events (case calendar event type, schedule start date and status, start time, room, and judge name)
- Criminal case defendant information (name, date of birth, address(es), sex, and race)
- Charges (charge number, grade, description, offense date, and disposition)
- Disposition/sentencing date (case disposition, disposition date, offense seq/description, ad offense disposition)
- Assessment (party name and amount assessed, adjusted, and paid)
- Judgment information (type, amount, status, writ type, and details)
- Docket entry information ( filed date and time, entry, subtype, description, and filer)
- Receipt (date, payor, number, and amount)
Where to Conduct a Delaware County Case Lookup
Record seekers can conduct a case lookup at the Delaware County Court of Common Pleas and District Courts. However, the Pennsylvania Supreme Court maintains records of cases appealed to the state courts.
How to Conduct a Delaware County Case Records Search
A Delaware County case records search can be done online, in person, via mail, email (OpenRecords@co.delaware.pa.us), or by Fax: (610) 891-8759). Online requests can be made via the Delaware County Web Portal. Click on the civil or criminal search tool to locate court records. Mail requesters must send a completed Open Records Request Form and the appropriate fees to the Clerk's Office or send a written request that contains the following information:
- Name and mailing address
- Email address or telephone number
- A detailed description of the record being sought
In-person requests can be made to the court where the case was filed. Most courts open from 8:30 a.m. to 4:30 p.m., Monday to Friday. A case number or party name will be required to complete the search.
Delaware County Civil Court Case Records
A Delaware County civil case record is a court document that provides information about a dispute or issue between two parties. The Delaware County Court of Common Pleas Civil Division hears and maintains cases involving individual lawsuits, liens against properties, unincorporated and incorporated businesses, and judgments against individuals. Requesters can use the Delaware County Court of Common Pleas' C-Track Public Access tool to conduct a civil record search. Searches can be conducted by case, document entry, document, judgment index, or party. Alternatively, requesters can contact the File Room by email at OJSfileroom@co.delaware.pa.us or visit the Civil Division during business hours to retrieve civil court records. Delaware County Criminal Court Case Records
Courts create criminal court case records during a criminal proceeding. In Delaware County, the Criminal Division handles and maintains all criminal case files, and interested members of the public can view criminal case records by querying the Division or using the Unified Judicial System of Pennsylvania Web tool. To use the tool, inquirers are required to enter the following information:
- Attorney
- Calendar event
- Citation number
- Complaint number
- Date filed
- Docket number
- Incident number
- Participant name
- Organization
- Offense tracking number (OTN)
- State identification number (SID)
Similarly, requesters can visit the Division during business hours to conduct a criminal court records lookup. The record staff will require a case number or party name before processing the request.
How to Get Court Records Online for Free
The Delaware County Court of Common Pleas permits members of the public to view court records online for free through their Web Portal. To use the C-Track Public Access tool:
- Go to the Civil Division website
- Click the View Online Civil Records link
- Conduct a search using the following parameters:
- Case Search: To find a record by case search, click the "Case Search" icon and fill in the case number and title in the boxes provided. Click on "Search". An "Advanced Search" requires a case filed date.
- Docket Entry Search: Click on the "Docket Entry Search" icon and fill in the case number and case filed date in the space provided. Click on "Search". An advanced search can also be performed using this method.
- Document Search: To use this method, click the "Document Search" icon. Fill in the case number, document name, and text in the boxes provided, and click on "Search".
- Judgment Search: To find a civil court record through this method, click the "Judgment Search" icon and fill in the case number and judgment filed date in the required spaces. Click on "Search".
- Party Search: Find party records in the system by name, type, or case information. Click on "Party Search" and fill in the case number, party name, and first name. Click on "Search".
